In recent cases, prosecutors in Montgomery County, Pennsylvania and Howard County, Maryland, were forced to withdraw their cases against DT following a pivotal cross-examination by Michael Diamondstein.
DT was facing a nightmarish situation: arrested, jailed, and extradited from Armenia, DT was charged with three (3) separate child rape cases in both Pennsylvania and Maryland. Because the allegations spanned incidents that purportedly occurred in Maryland, Pennsylvania, and Armenia, there would be trials in both states for the same complainants. If convicted on the multiple counts, DT would face many lifetimes in jail and SORNA/Megan’s Law Registry requirements. Thanks to Diamondstein’s zealous investigation and a number of explosive cross-examinations, all the cases were dismissed.
The Montgomery County, Pennsylvania trial went first. Diamondstein, knowing that the allegations were untruthful, baited the government’s witnesses into denying what he knew to be true. When the witnesses were solidly locked in, Diamondstein sprung the trap, eviscerating their testimony. In the middle of the cross-examination of the ultimate witness, the Montgomery County Assistant District Attorney admitted
“[i]n light of the evidence and how it came out yesterday during the cross-examination, and text messages that the Commonwealth did a phone download of [DT]’s cellphone . . . . [I]t has been the decision of the Commonwealth to withdraw and nolle-pros the case at this time.”
As one observer of the victory noted, “in 25 years in Montgomery County, I have never even heard of the Commonwealth withdrawing prosecution mid-jury trial.” Despite the win in Montgomery County, DT was then transported to Maryland to face the remaining cases. However, when the Maryland prosecutor reviewed the record of the Pennsylvania trial, she admitted that she could not move forward and withdrew all charges. Freed after nearly three years in jail, DT said:
“Mike has literally saved my life! I thought my situation was completely hopeless, but because of his hard work and brilliance justice has prevailed!”
